REVEALED: IRS Leadership Conspired with Holder Justice Department to Imprison Political Opponents

Continuing its stellar track record of investigative journalism, JudicialWatch today announced it had unearthed emails between Lois Lerner of the IRS and Eric Holder’s DOJ that suggested they had explored methods to prosecute and imprison conservative groups for the temerity of opposing the Obama administration.

Judicial Watch today released a new batch of internal IRS documents revealing that former IRS official Lois Lerner communicated with the Department of Justice (DOJ) about whether it was possible to criminally prosecute certain tax-exempt entities. The documents were obtained as a result of an October 2013 Judicial Watch Freedom of Information Act (FOIA) lawsuit filed against the Internal Revenue Service (IRS) after the agency refused to respond to four FOIA requests dating back to May 2013.

The newly released IRS documents contain an email exchange between Lerner and Nikole C. Flax, then-Chief of Staff to then-Acting IRS Commissioner Steven T. Miller discussing plans to work with the DOJ to prosecute nonprofit groups that “lied” (Lerner’s quotation marks) about political activities.

Writing at PJ Media, Bryan Preston well summarizes the implications of this horrifying scandal that makes Nixon look like a shoplifter at the Dollar Store.

The implications of today’s email disclosure are stunning and terrifying.

Lois Lerner intended to use her position atop the IRS’ tax exempt approval office to coordinate the prosecution of political speech. The Department of Justice under Attorney General Eric Holder had at least tentatively bought into that. The Federal Elections Commission was being roped in as well. Lerner’s emails prove that beyond doubt.

Democrats in Congress were involved. Rep. Elijah Cummings (D-MD) appears to have led the anti-constitutional attack on free speech in the House. Sen. Sheldon Whitehouse (D-RI) led it from the Senate.

Two days before Lerner was forced to publicly disclose the scandal, she was moving forward with an insidious plan to stamp out conservatives and Tea Party activists’ ability to organize and raise money, by working with the IRS commissioner’s office and the Department of Justice. At the same time, there was no plan for any government crackdown on groups who agreed with President Obama. The traffic was entirely one-way. It was nakedly political, and everyone involved knew it. They also had reason to believe that they would succeed, or they would not have engaged in it. DOJ would serve two roles: Prosecute conservatives, and protect the bureaucrats who were pushing those prosecutions.

But, “nation of cowards” and “racism”, y’all.

Any conservative who sits on the sidelines in 2014 bemoaning candidates that aren’t to his or her liking is effectively a co-conspirator with the Democrats in the active destruction of this Republic.

We have a President, an Attorney General, a ranking member of the House Oversight Committee, the IRS, the FBI, and heaven knows what other alphabet soup agencies conspiring to jail political opponents. Our country has been reduced to something akin to Venezuela, only with craploads more debt.

That, my friends, is fascism, straight up.

So when you sit out the next election because you couldn’t find the perfect Republican candidate, don’t act surprised when this corrupt, lawless, totalitarian Democrat Party comes after you and your group.

So you can mobilize to stop this, or you can echo Alexander Solzhenitsyn in his masterful The Gulag Archipelago. It related to the greatest regret of those in the slave labor camps:

What would things have been like if every Security operative, when he went out at night to make an arrest, had been uncertain whether he would return alive and had to say good-bye to his family? Or if, during periods of mass arrests, as for example in Leningrad, when they arrested a quarter of the entire city, people had not simply sat there in their lairs, paling with terror at every bang of the downstairs door and at every step on the staircase, but had understood they had nothing left to lose and had boldly set up in the downstairs hall an ambush of half a dozen people with axes, hammers, pokers, or whatever else was at hand? –Part I The Prison Industry, Ch. 1 “Arrest” (p13, The Gulag Archipelago, Collins 1974)

The radicals in the Obama administration today attack us confident that the Republican “leadership” will do nothing to stop them. That is why the lesson of Cliven Bundy is so crucial: Democrats must be reminded at each turn that their safety will vanish if they turn to violence.

Therefore we must smash them politically in November before that horrible line is crossed.

IRS POLITICAL HITMAN LOIS LERNER: Go to jail. Go directly to jail. Do not pass Go. Do not collect $200.

Guest post by Investor’s Business Daily

Corruption: A House panel votes this week to formally ask the DOJ to pursue criminal charges against former IRS employee Lois Lerner. It is time someone in this administration were held accountable for something.

A staff report by House Oversight Committee chairman Darrell Issa reveals testimony by IRS agents that the IRS has not deliberately targeted progressive groups. Now comes word that the House Ways and Means Committee is sending a letter to Attorney General Eric Holder accusing former IRS director of tax-exempt organizations Lois Lerner of committing at least three crimes in the IRS’s targeting tea party and other conservative groups seeking tax-exempt status.

That crimes have been committed and the Internal Revenue Service has become a corrupt criminal enterprise used to bludgeon political opponents of the Obama administration is hardly in dispute. The charge might have long ago been adjudicated had the Justice Department of Eric Holder, rife with its own very real scandals, not been politicized beyond all recognition.

According to the report, obtained by the Daily Caller, “Only seven applications in the IRS backlog contained the word ‘progressive,’ all of which were then approved by the IRS, while tea party groups received unprecedented review and experienced years-long delays.”

The enhanced scrutiny included demands for confidential donor information of the type the IRS has provided to political opponents of conservative groups in the past. We need only look at the blacklisting of Mozilla CEO Brendan Eich after his donations opposing California’s Proposition 8 were revealed.

In March 2012, someone at the IRS released the confidential donor lists of the National Organization for Marriage (NOM), which supports traditional marriage, to its political opponent, the liberal Human Rights Campaign (HRC), a supporter of gay marriage.

At that time, Joe Solmonese, a left-wing activist and Huffington Post contributor, was the president of the HRC. Solmonese also became a 2012 Obama campaign co-chairman.

Shortly thereafter, NOM’s tax return and its confidential list of donors and their addresses showed up on the HRC website.

Lois Lerner’s knowledge of and participation in planning to use the IRS as a political weapon, in coordination with the White House, is why she twice invoked the Fifth Amendment in her Congressional visits, even as she was cooperating — or is it coordinating? — with Eric Holder’s Justice Department.

Hans Von Spakovsky, senior legal fellow at the Heritage Foundation, says government officials can’t pick and choose when and where they invoke their Fifth Amendment rights. They can’t legally give information to the DOJ that they withhold from Congress.

“When Lerner gave a lengthy interview to the government, she waived the Fifth. There’s no doubt about it,” says Von Spakovsky. “The law is crystal clear here in the District of Columbia. That means when she showed up March 5, she was obligated to provide the same information.”

House Ways and Means Chairman Dave Camp, whose committee has access to confidential taxpayer information as part of its investigation, did not specify which laws Lerner may have broken.

If the committee votes to refer Lerner to the Justice Department, it is expected to make the referral public. This is separate from a possible contempt-of-Congress citation, also a possibility.

“My question isn’t about who’s going to have to resign,” House Speaker John Boehner said during a news conference Wednesday. “My question is, who’s going to jail over this scandal?”

Indeed, the IRS scandal is looming as a criminal conspiracy that makes Watergate look like a fraternity prank. Our recommendation would be to start the investigation with Lois Lerner.

IRS COMMISSIONER MOCKS CONGRESS: Dares Oversight to Hold Him in Contempt Over Political Targeting

It isn’t pretty when the rule of law begins crumbling right before our eyes.

IRS Commissioner John Koskinen told a House panel that congressional investigators can try to hold him in contempt over the Tea Party targeting scandal whenever they think that they can make the charge stick, something he thinks is unlikely.

The topic came up when Rep. Mark Meadows, R-N.C., asked for a date at which it would be appropriate for agency officials to be held in contempt if they have not yet provided the House Oversight and Government Reform Committee with documents that have been requested from the IRS.

“I think the timeline is whenever you think you could actually sustain that in a court,” Koskinen replied. “I think we have a strong case that we have been cooperative, continue to be cooperative, and anybody looking at the systems we have and the time it takes would find that we’ve provided you more cooperation than, in fact, might be expected. And I think that, in fact, arguing and threatening contempt in that situation without understanding the circumstances is probably not going to be held up.”

It wasn’t the only time that accusations flew during a testy congressional hearing, as Rep. Jim Jordan, R-Ohio, forced Koskinen to admit that he had patterned his testimony on a proposed regulation affecting the political activity of nonprofits after a Treasury Department official’s letter to Congress. Koskinen had previously said he had not conferred with administration officials.

Remember, House Speaker John Boehner refuses to name a Select Investigative Committee to conduct a formal inquiry with dedicated and experienced staff members.

Chalk this up as reason #4,035 that Boehner needs to go.

Political Smutmonger David Brock Decries Political Smutmongers

Guest post by D-Day

I have a new favorite word – smutmonger. After reading countless stories about the “recovered” Clinton smutmongerer David Brock today, I found it ironic that the one blasting smutmongers runs a super PAC with the sole mission of tracking candidates to smutmonger them. Guess I shouldn’t be surprised reporters have left that out of their reporting.

SHOT: Politico: David Brock blasts ‘political smutmongers’
Brock: “Call off the political smutmongers,” he said, according to a prepared copy of the speech released by his team. “…Give the American people the presidential campaign they deserve, one based on real issues and on the public record. Ask —‘is it relevant to someone’s performance in public office?’ —before attacking.”

CHASER: NYT: Trailing G.O.P. With Cameras, Seeking Gaffes
Aaron Fielding quietly stalks his prey — Republicans — with his video camera, patiently waiting for a political moment worthy of YouTube. At 27, he is a full-time “tracker” for American Bridge 21st Century, a new Democratic organization that aims to record every handshake, every utterance by Republican candidates in 2011 and 2012, looking for gotcha moments that could derail political ambitions or provide fodder for television advertisements by liberal groups next year.
