COLLUSION: Oversight’s Elijah Cummings (D) Collaborated With IRS to Target Conservatives Then Lied About It

The wound to the Republic keeps festering, the infection growing deeper and more febrile. Katie Pavlich reports:

New IRS emails released by the House Oversight Committee show staff working for Democratic Ranking Member Elijah Cummings communicated with the IRS multiple times between 2012 and 2013 about voter fraud prevention group True the Vote. True the Vote was targeted by the IRS after applying for tax exempt status more than two years ago. Further, information shows the IRS and Cummings’ staff asked for nearly identical information from True the Vote President Catherine Engelbrecht about her organization, indicating coordination and improper sharing of confidential taxpayer information.

Chairman of the House Oversight Committee Darrell Issa, along with five Subcommittee Chairmen are demanding Cummings provide an explanation for the staff inquiries to the IRS about True the Vote and for his denial that his staff ever contacted the IRS about the group.

“Although you have previously denied that your staff made inquiries to the IRS about conservative organization True the Vote that may have led to additional agency scrutiny, communication records between your staff and IRS officials – which you did not disclose to Majority Members or staff – indicates otherwise,” the letter to Cummings states. “As the Committee is scheduled to consider a resolution holding Ms. Lerner, a participant in responding to your communications that you failed to disclose, in contempt of Congress, you have an obligation to fully explain your staff’s undisclosed contacts with the IRS.”

…Up until this point, Rep. Cummings has denied his staff ever contacted the IRS about True the Vote and their activities during Oversight hearings. In fact, on February 6, 2014 during a Subcommittee hearing where Engelbrecht testified, Cummings vehemently denied having any contact or coordination in targeting True the Vote when attorney Cleta Mitchell, who is representing the group, indicated staff on the Committee had been involved in communication with the IRS…

Issa has gone so far as to accuse Cummings of instigating the partisan witch-hunt against True the Vote.

In February 2012, Engelbrecht’s True the Vote received a letter from the IRS requesting more information about the group; one of Cummings’s letters, which Engelbrecht received in October 2012, contained questions that closely mirrored those posed by the IRS. Issa details them in his letter, strongly implying that Cummings based his letter on the one Engelbrecht had already received from the agency: Both requested information about the software True the Vote was using for voter registration, about the process the group used to train its employees, and about the vendors it used to obtain voter lists.

True the Vote’s lawyer, Cleta Mitchell, raised the prospect that the minority staff had exchanged information with the IRS at a hearing in February. “We want to get to the bottom of how these coincidences happened,” Mitchell said, “and we’re trying to figure out whether any — if there was any staff on this committee that might have been involved in putting True the Vote on the radar screen of some of these federal agencies.” Cummings said in response that Mitchell’s tacit allegation was “absolutely incorrect and not true.”

No wonder Cummings has been so anxious to suppress the investigation: he’s been intimately involved with the scandal.

Cummings should be censured and removed from the committee. Of course, knowing the cowardly leaders of the GOP, they’ll moan “it’s a sad day”, and do nothing.

Based on my notes, Democrats have succeeded in hitting the trifecta of government corruption. We have a lawless President, a lawless Attorney General, and a lawless House Oversight Committee Ranking Member.

These people need to be dispatched in November and held to account. Talk to your family members, your friends and your colleagues. We have a rogue government; it can not stand if this country is to survive.

PERJURY: House Oversight Committee Says Lois Lerner Lied to Congress at least Four Times

It would appear that former IRS executive Lois Lerner could soon be held in contempt of Congress and — as an added bonus — charged with perjury.

[The House Oversight committee report] states that [former IRS overseer Lois] Lerner made false statements to committee staff on various occasions.

During a February 2012 briefing, Lerner told committee staff that the criteria for evaluating tax-exempt applications had not changed. According to the Treasury Inspector General for Tax Administration (TIGTA), however, Lerner directed in June 2011 that the criteria used to identify applications be changed.

As Moe Lane observes, Lois Lerner now faces a very serious life-decision:


I don’t think that Darrell Issa is contemplating contempt charges. I think that he’s letting Ms. Lerner know that she has to decide soon whether it’s going to be her scalp that goes up on the lintel. House Oversight has no real reason not to put a former Director of IRS Exempt Organizations in jail for a few years, particularly if they can also convict a suitable number of subordinates: it would be nice to get the people in the Executive Branch who gave the orders, but putting the fear of God and Congress into those who got the orders will also pay dividends.

But, obviously if Lois Lerner is not the biggest fish in this investigation then Darrell Issa would like to get his hands on the one who is. That is Ms. Lerner’s only real bargaining card right now; I look forward to seeing her next play.

The House Oversight Committee summarized Lerner’s role as follows:

Through e-mails, documents, and the testimony of other IRS officials, the Committee has learned a great deal about Lois Lerner’s role in the IRS targeting scandal since the Committee first issued a subpoena for her testimony. She was keenly aware of acute political pressure to crack down on conservative-leaning organizations. Not only did she seek to convey her
agreement with this sentiment publicly, she went so far as to engage in a wholly inappropriate effort to circumvent federal prohibitions in order to publicize her efforts to crack down on a particular Tea Party applicant. She created unprecedented roadblocks for Tea Party organizations, worked surreptitiously to advance new Obama Administration regulations that curtail the activities of existing 501(c)(4) organizations – all the while attempting to maintain an appearance that her efforts did not appear, in her own words, “per se political.”

I don’t care whether the President is Republican or Democrat. The politicization of the IRS is inexcusable and should be grounds for impeachment.

Furthermore, an example should be made of Lois Lerner. A very painful example.

The hospital offers a “charity” program to help people without insurance but I have to prove I have been rejected from Medicaid first. So I spent last night filling out the stupid amounts of paperwork required for that. At the end of my 20+ page packet I got 3 separate voter registration forms for me and anyone else who is needs aid and will probably vote Democrat.

It annoyed me. Mostly because I meet people all the time who don’t vote because it doesn’t matter. The thing is it is the people who aren’t working and live off the government ARE voting and are *constantly* recruited to do so.

OH, MY: It would appear administration officials Henry Chao and Marilyn Tavenner lied under oath to Congress

Mr. Peabody, set the Wayback Machine to July 17, 2013, please. Let’s review testimony before the House Oversight Committee by Obama administration officials regarding the October 1st launch of Healthcare.gov.

With the NSA’s phone call monitoring and Edward Snowden on many minds, it’s not exactly a comfortable time for the government to roll out a massive computer project dealing with personal data like income, Social Security numbers and ethnicity.

But Henry Chao, a lead technology information officer from the Centers for Medicare & Medicaid Services, said officials have completed about 80 percent of the safeguards to protect privacy when the agency rolls out what it calls “The Hub.” … “It is important to understand that the hub is not a database; it does not retain or store information,” said Marilyn Tavenner, the CMS administrator, during a heated congressional hearing Wednesday.

She and Chao said the agency will complete the required tests and meet privacy regulations by Oct. 1, when health exchanges are scheduled to open. Their comments came in testimony to the House subcommittee on energy policy, health care and entitlements, which is part of the Oversight and Government Reform Committee…

Tuck the date of 17 July 2013 away. Now let’s review some email traffic flying around Chao’s office less than two weeks prior to that pair’s testimony.

In emails from July, released by the House Energy and Commerce Committee, Obama administration officials write of unskilled developers and a series of missed deadlines. One email said the “entire build is in jeopardy.” But when the administration’s top people in charge of the implementation testified before the committee in the months leading up to the site launch, they said just the opposite — that they were ready…

• The only developer who was working on the payment pages for enrollment quit CGI without programming the 10 key user interface pieces of the transaction part. “Needless to say it is in jeopardy,” wrote CMS’ Jeffrey Grant.

• The part of the system that does monthly payment calculation of insurance plans did not get priority by the contractor, who called it “not an October 1 item.” (The health care insurance website launched Oct. 1.)

• “Seriously substandard staffing,” is how Grant described its contractor’s people power. The key contractor, CGI, missed deadlines due to “insufficient” programmer resources. A month from testing certain parts of the system, no development work had even started.

When informed by Grant of the complete unraveling of the project, Chao was in denial.

There’s government-quality management for you: instead of trying to get to the bottom of Grant’s dire status report, Chao instead sought to “refute” it.

In other words, Chao and Tavenner were well aware that all of the site’s testing — not just the penetration and other security tests — all of the site’s tests were in dire jeopardy.

Contempt of Congress, anyone?

As I asked about Benghazi, and Fast and Furious, and IRS-gate: where the hell is the Select Investigative Committee? That’s the only way we’ll get to the bottom of these unprecedented assaults on the Constitution by the most lawless administration in modern American history.
